These terms govern the sales of flower bouquets made on the website www.madame-artisanfleuriste.com

Article 1 - Purpose and scope of application

These Terms and Conditions of Sale (hereinafter "T&Cs") exclusively govern the contractual relations between:

  • - Madame-ArtisanFleuriste.com (trading name of Uzerhack), an online flower bouquet sales company, hereinafter referred to as "the Seller"
  • - Any natural or legal person wishing to purchase products offered for sale on the website www.madame-artisanfleuriste.com, hereinafter referred to as "the Customer" or "the Purchaser"

These T&Cs apply to the exclusion of all other conditions, and in particular those applicable to other marketing channels or other sales channels.

Placing an order implies the Purchaser's full and unreserved acceptance of these T&Cs, to the exclusion of all other documents, general conditions, special conditions, charters, guides or others.

These terms and conditions of sale govern all orders placed on Madame-ArtisanFleuriste.com.

The ordering process is validated by the customer's online payment.

Madame-ArtisanFleuriste.com reserves the right to modify the terms and conditions of sale at any time. The version of the terms and conditions of sale applicable to an order is that in force on Madame-ArtisanFleuriste.com at the time of order confirmation by the customer.

Article 2 - Products and services

The Seller offers for sale flower bouquets and floral compositions deliverable in mainland France, excluding Corsica and overseas territories (Guadeloupe, French Guiana, Martinique, Réunion, Mayotte, Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, French Polynesia, Wallis and Futuna, New Caledonia and the French Southern and Antarctic Lands).

2.1 Product characteristics

The products offered are those shown on the website www.madame-artisanfleuriste.com. The photographs and descriptions of the products are as accurate as possible but cannot guarantee perfect similarity with the delivered product, particularly with regard to colours and shades.

As the products are handcrafted by florists, variations may exist depending on arrivals and flower availability. Nevertheless, the Seller undertakes to respect the number of flowers, the dominant colour and the style of the bouquet ordered.

2.2 Availability

All products are offered subject to available stock. In the event of a product being unavailable after the order has been placed, the Customer will be informed as soon as possible. The Customer may then request cancellation of the order with full refund of the sums paid.

Article 3 - Prices

Product prices are indicated in euros (€) including all taxes (inc. VAT), including VAT applicable on the day of the order.

The prices indicated do not include delivery charges. The Customer is informed of the amount of delivery charges on the descriptive page of the chosen bouquet and of the total price of the order before final validation of the order.

The Seller reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the prices in force at the time of order validation by the Customer.

Prices do not include any fees for accessing the website which remain the exclusive responsibility of the Customer (internet/mobile package, etc.).

The Customer may benefit from a discount voucher valid on the website, entitling them to a discount on the purchase of a bouquet and/or reduced/free delivery charges. The specific terms of use and in particular: minimum purchase amount, period of use, and other conditions of application will be specified when the discount voucher is communicated.

Article 4 - Orders

4.1 Ordering process

The Customer selects the products they wish to order, according to the following procedures:

  • Choice of bouquet (type, size, colour)
  • Selection of desired delivery date
  • Provision of sender's details
  • Provision of recipient's details. Important point: we will only process orders to mainland France, the following destinations cannot be delivered by the Seller: Corsica, Guadeloupe, French Guiana, Martinique, Réunion, Mayotte, Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, French Polynesia, Wallis and Futuna, New Caledonia and the French Southern and Antarctic Lands.
  • Option to add a personalised message
  • Basket validation and proceed to payment

4.2 Order validation

Order validation entails:

  • Full and complete acceptance of these T&Cs
  • Acknowledgement of having full knowledge of them
  • Creation of a firm and final sales contract

The sale will only be considered final after the Seller sends the Customer confirmation of acceptance of the order by email and after receipt by the Seller of the full price.

4.3 Order confirmation

The Seller sends the Customer an order confirmation by email containing the order details. The Customer is invited to verify the accuracy of the order and to report any error immediately.

Important: It is the Customer's responsibility to verify the accuracy of the recipient's details. The Seller cannot be held responsible for a delivery error resulting from inaccurate or incomplete details provided by the Customer.

Article 5 - Payment methods

5.1 Accepted payment methods

Payment is made by:

  • Credit Card (CB, Visa, Mastercard, American Express, Discover, Diners Club, JCB, China UnionPay)
  • Apple Pay, Google Pay, Amazon Pay, Revolut Pay
  • PayPal, Link

5.2 Payment security

Online payments are secured by Stripe, our payment service provider which guarantees the security and confidentiality of data exchanges. Confidential data (credit card number, etc.) is directly transmitted encrypted to Stripe's payment server without passing through the Seller's server physical media.

The Seller receives from Stripe nor stores any banking data on its servers.

5.3 Price payment terms

The price is payable in cash, in full, on the day the order is placed by the Customer. The Seller reserves the right not to process an order in the event of refusal of payment authorisation or in the event of previous non-payment. We specify that the price of the bouquet and delivery charges are not deposits.

If the customer does not provide all the information or transmits incorrect information, abandons entry or in the event of a payment incident, the order is automatically cancelled.

Article 6 - Delivery

6.1 Geographical area

Deliveries are made in mainland France only, excluding Corsica and the overseas territories mentioned above.

Deliveries are not possible in 'public' places such as: cemeteries, crematoriums, places of worship, hospitals, hotels, restaurants, barracks, military bases, airports, prisons, town halls, embassies, prefectures, law courts, entertainment or reception venues, stadiums, schools, universities, administrative buildings. To be clear, no delivery is possible in a public place, a place open to the public or receiving the public.

6.2 Delivery times

The Seller offers two types of delivery:

  • Same-day delivery: For orders placed before 4:30 pm on weekdays (10:30 am on Sundays), if available at the time of order, guaranteed same-day delivery
  • Next-day delivery: Guaranteed delivery the day after the order (if available at the time of order)
  • Scheduled delivery: On a later date chosen by the Customer when ordering, the Customer can order up to D+8 from the current date

Delivery times are given as an indication. The Seller undertakes to implement all necessary means to respect the announced deadlines.

6.3 Delivery procedures

Delivery is carried out either by a local partner florist to the address indicated by the Customer when ordering, or by special parcels delivered by a delivery partner (DPD, Colissimo, Chronopost, UPS, FedEx, DHL or other depending on the destination and requirements). The recipient must be present to receive the bouquet.

In the event of the recipient's absence, the delivery person leaves a notice of attempted delivery. The recipient then has the following options:

  • Arrange a new delivery slot within 48 hours maximum
  • Collect the bouquet from the partner florist's shop
  • Indicate a secure deposit location (with explicit agreement)

6.4 Delivery liability

The Seller undertakes to deliver the products within the agreed time limits. In the event of a delivery delay of more than 24 hours from the scheduled date, the Customer may request:

  • Maintaining the order and refund of delivery charges (€9.99)
  • Cancellation of the order with full refund of sums paid

The Seller cannot be held responsible for delivery delays due to:

  • Inaccurate or incomplete details provided by the Customer
  • Absence of the recipient without possibility of contact
  • Force majeure events (exceptional weather conditions, strikes, etc.)
  • Refusal by the recipient of the bouquet or parcel (depending on the type of delivery person: florist or carrier)
Attention: For sensitive deliveries (birthdays, special events), it is recommended to ensure the recipient's availability at the indicated address.

Attention: For deliveries on 'flower celebration' days (notably Valentine's Day, Mother's Day or Grandmothers' Day), due to a high volume of orders to be processed by our partner florists, it will not always be possible to ensure a same-day order, but we will inform the Customer in these cases and it will always be possible to cancel the order as long as it is not deemed 'in delivery'. We invite Customers to order at least the day before these events to avoid this kind of inconvenience.

Attention: In the absence of contact from the Recipient to schedule redelivery of the ordered bouquet within 3 working days following the first delivery attempt (florist or carrier), the customer will not be entitled to any refund or damages. And this is also valid if the Recipient schedules a delivery appointment after exceeding the storage time of the perishable bouquet which is 48 hours following the first delivery attempt.

Article 7 - Right of withdrawal and exceptions

7.1 Principle

No right of withdrawal for floral products containing flowers or plants.

In accordance with Article L221-28 4° of the Consumer Code, products containing fresh flowers and plants being, by nature, very quickly perishable, the right of withdrawal is excluded for orders containing fresh flowers and plants placed on the Madame-ArtisanFleuriste.com website

7.2 Satisfaction guarantee

Although the right of withdrawal does not apply, the Seller undertakes to satisfy its customers. In the event of manifest non-conformity or proven quality defect, the Customer must:

  • Contact customer service within 24 hours following delivery
  • Provide photographs of the product received
  • Describe precisely the problem encountered

The Seller undertakes to provide a rapid solution: replacement of the bouquet, total or partial credit, or total or partial refund as appropriate.

Article 8 - Guarantees and complaints

8.1 Guarantee of conformity

The Seller guarantees that the products conform to the descriptions and photographs presented on the website, subject to variations inherent in natural and handcrafted products.

8.2 Complaints

Any complaint relating to non-conformity or quality defect must be made:

  • By email contact@madame-artisanfleuriste.com or via the contact form
  • Within 24 hours after delivery
  • Accompanied by photographs of the product received

After this period, no complaint can be taken into account given the perishable nature of the products.

If the lack of conformity is minor, that is to say if the differences between the delivered product and its description and photographs present on the website are not substantial, no complaint will be accepted.

The lack of conformity will be considered substantial if the differences between the delivered products and its description and photographs present on the website are greater than 30% based on the following criteria:

  • Non-compliance with floral choice: theme and/or shape and/or main colours and/or dominant flowers
  • Non-compliance with product size, i.e. non-compliance with the indicated number of flowers
  • Poor quality of flowers

8.3 Seller's liability

The Seller's liability is limited to the amount of the order. The Seller cannot be held responsible for indirect or intangible damage resulting from the use or inability to use the products sold.

Article 9 - Order modification or cancellation

9.1 By the Customer

Cancellation of an order is only possible if the floral product has not yet been created or packaged for delivery and/or no costs have been incurred for its preparation, packaging or delivery. In our process, no cancellation is possible from the moment the Customer has received the email indicating that their order is being processed (second email sent by Madame-ArtisanFleuriste.com when an order is placed).

Requests must be sent to customer service by email contact@madame-artisanfleuriste.com or via our contact form. Written confirmation will be sent to the Customer.

In the event of cancellation within the deadlines, the Customer will be fully refunded. After these deadlines, no modification or cancellation can be accepted, as the preparation and delivery process is already underway.

9.2 By the Seller

The Seller reserves the right to cancel an order in the event of:

  • Unavailability of the ordered product
  • Refusal of payment authorisation
  • Incorrect or incomplete details preventing delivery
  • Suspected fraud

In all cases, the Customer will be informed and a full refund will be made.

Article 10 - Protection of personal data

In accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act, the Customer has a right of access, rectification, deletion and objection to personal data concerning them.

The data collected is used exclusively for:

  • Processing and tracking orders
  • Invoicing
  • Customer relationship management
  • Sending information concerning the order

This data is never transmitted to third parties without the Customer's explicit consent, except legal obligation.

Article 11 - Intellectual property

All content on the website www.madame-artisanfleuriste.com (texts, images, photographs, logos, trademarks, etc.) is the exclusive property of the Seller or is subject to authorisation for use.

Any reproduction, representation, modification, publication, transmission, total or partial alteration of the website or its content, by any process whatsoever, and on any medium whatsoever is prohibited without the prior written authorisation of the Seller.

Any unauthorised use of the website or its content would engage the user's liability and constitute counterfeiting punishable under Articles L. 335-2 et seq. of the Intellectual Property Code.

Article 12 - Force majeure

The Seller's liability cannot be engaged in the event of force majeure or events beyond its control, such as:

  • Natural disasters
  • Fires, floods
  • Total or partial strikes
  • Riots, wars
  • Epidemics
  • Blockages of means of transport or supply
  • Internet network failures
  • Interruption of energy supply

In such circumstances, the Seller will inform the Customer as soon as possible and the parties will agree together on the terms of settlement of the order.

Article 13 - Mediation and dispute resolution

13.1 Consumer mediation

In accordance with Article L. 612-1 of the Consumer Code, the Seller offers a consumer mediation system.

In the event of a dispute, the Customer may contact free of charge the consumer mediator to whom the Seller reports:

13.2 Amicable settlement

The parties undertake to seek an amicable solution to any dispute that may arise in the performance of this contract before initiating any legal proceedings.

13.3 Applicable law and jurisdiction

These T&Cs are subject to French law.

Any dispute relating to the interpretation and execution of these T&Cs is subject to French law. Failing an amicable resolution, the dispute will be brought before the competent French courts.

Article 14 - Acceptance and modification of T&Cs

These T&Cs are accessible at any time on the website www.madame-artisanfleuriste.com and will prevail over any other version or any other contradictory document.

The Seller reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in force on the date of the Customer's order.

If one or more provisions of these T&Cs are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions will retain their full force and effect.
